Dear Mr. Patterson:
This is to acknowledge U.S. Nuclear Regulatory Commission (NRC) receipt of Honeywell Metropolis Works updated Emergency Response Plan (ERP), Revision 12 (Agencywide Document Access and Management System [ADAMS] Accession Number ML23115A397).
The updated ERP incorporates changes made on November 28, 2022, which reflect the current activities associated with the preparation of the plant for eventual start-up in calendar year 2023. In your submittal, you also stated that, per License Condition 32 of Honeywells source materials license SUB-526, Revision 12 of the ERP is equivalent to Revision 9 of the ERP. The NRC licensing staff completed a preliminary review of the information provided and identified no major deficiencies.
As discussed in Staff Requirements Memorandum for SECY-16-0009, Recommendations Resulting from the Integrated Prioritization and Re-Baselining of Agency Activities (ADAMS Accession Number ML16104A158), the NRC licensing staff will no longer perform detailed reviews of changes made by the licensees under the change authority provisions in Title 10 of the Code of Federal Regulations (10 CFR) 40.35, 70.32, and 70.72.Therefore, we are referring your submittal to the NRC Region II inspection staff for further evaluation of the updated ERP during inspections of your facilitys licensed activities.Please note that no cost activity code is being assigned to this action.
In accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this communication will be available electronically for public inspection in the NRC Public Document Room or from ADAMS.ADAMS is accessible from the NRC Web Site at http://www.nrc.gov/reading-rm/adams.html.
