Dear Chair Murray:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am submitting this report on the NRC's plan regarding the continued operation of Diablo Canyon Power Plant (Diablo Canyon), Units 1 and 2. This report is in response to the 2023 Consolidated Appropriations Act (the Act) explanatory statement which directed the NRC to provide a plan for the continued operation of Diablo Canyon not later than 180 days after enactment of the Act. The report describes the necessary steps and timeframes for the continued operation of Diablo Canyon under the NRC's license renewal process and the NRC's authority, and whether any changes to this authority would be required, to ensure the continued operation of a nuclear plant in the absence of a license application extension request.
