AFFIDAVIT OF ROBATEL TECHNOLOGIES, LLC CONCERNING CONFIDENTIAL INFORMATION AND TRADE SECRETS PURSUANT TO 10 CFR 2.390
Commonwealth of Virginia County of Roanoke
I, Jared Bower, Chief Executive Officer of Robatel Technologies, LLC., hereinafter referred to as Robatel, at 5115 Bernard Drive Suite 304, Roanoke, VA 24018, depose and say that:
I am duly authorized to make this affidavit and have reviewed or caused to have reviewed the information which is identified below as proprietary, confidential and/or trade secret information that should be withheld from public disclosure according to 10 CFR 2.390(b).
The information to be withheld includes the following Robatel Proprietary Information that is being provided in this submittal:
Enclosure 1: Robatel Type B(U) Transportation Cask Pre-Application Meeting Presentation
The basis for withholding the information identified above is that the information presented contains trade secrets developed over more than 70 years in the industry that provides Robatel with a competitive edge in the market (10 CFR 2.390(a)(4)).
The trade secret information contained in this presentation, if used by a competitor, would reduce their expenditure of resources, or improve their competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product. As such, public disclosure of this information severely damages Robatel Technologies' ability to compete for and perform future work.
Locations in the documents to be withheld include all pages clearly marked in red at the top of the page "Proprietary/trade secret information - withhold from public disclosure under 10 CFR 2.390".
The information contained within the cited presentation is a culmination of over 70 years of expertise in the design, manufacture, shipment, installation, quality assurance, and licensing of Type B casks including, but not limited to, fabrication techniques, shielding design, shielding analysis methodology, and lifting and handling operations. In addition, a novel and unique procedure for processing the content is disclosed in this presentation as well.
Only the stakeholders of this project have knowledge of this trade secret information and is bound by non-disclosure agreements. This information is transmitted to the Commission in confidence for the purposes of reviewing details and methodologies prior to the license application submission.
The aforementioned information has not been made publicly available and public disclosure of the information will have a significant impact on the competitive position of Robatel and the other stakeholders in this project.
