April 26, 2023 ALL AGREEMENT STATES, CONNECTICUT, INDIANA, WEST VIRGINIA FEDERALLY RECOGNIZED TRIBES NRC NMSS, NRC REGIONS I, III AND IV NOTIFICATION OF THE ISSUANCE OF PROCEDURE SA-900, TERMINATION OF URANIUM MILLING LICENSES IN AGREEMENT STATES (STC-23-029)

Purpose:

To inform the National Materials Program (NMP) community (States and U.S. Nuclear Regulatory Commission (NRC) and Federally Recognized Tribes that Office of Nuclear Material Safety and Safeguards (NMSS) State Agreements (SA) procedure SA-900, Termination of Uranium Milling Licenses in Agreement States, has been revised and approved for use.

Background:

The last revision of SA-900 was issued on May 17, 2010, and is available in the Agencywide Documents Access and Management Systems (ADAMS) under Accession No. ML101130527. On October 6, 2022, NRC staff issued Notification of the Opportunity To Comment On SA-900, Termination of Uranium Milling Licenses in Agreement States (STC 060) ML21165A141) to provide the NMP community an opportunity to comment on the draft procedure. The comment period ended on December 5, 2022. Two Agreement States and U.S.

Department of Energy Land Management provided comments on the procedure and NRC staff accepted the comments and incorporated them into this revision (ML23019A062).

Discussion: SA-900 has been revised to incorporate lessons learned since the 2010 revision, incorporate the principles of NRCs Tribal Policy Statement adopted in 2017 to guide NRC engagement and consultation with Federally Recognized Tribes, and enhance early communication between the NRC and Agreement States during the license termination process of uranium mills.

This procedure has been uploaded to the NRC website for use: https://www.nrc.gov/reading-rm/doc-collections/nmss-procedures/state-agreement.html. The procedure can be also found in ADAMS under Accession No. ML23019A059.
