Dear Mr. Semancik,

Thank you for your letter of March 24 regarding fusion energy systems, sent on behalf of the Conference of Radiation Control Program Directors Committee on Commercial Nuclear Power (E-47). We appreciate your engagement in providing information for the Commission's consideration.

Last week, the Commission approved the staff's option to regulate fusion energy systems under the NRC's byproduct material framework contained in 10 CFR Part 30 and associated regulations. Our next steps will include engagement with the Agreement States, public, and other interested stakeholders on a limited revision to materials licensing regulations, as well as materials license guidance to cover fusion systems. We look forward to continuing the state partnerships you referenced in your letter.
