Dear Mr. Chairman:

May 15, 2023 On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am transmitting the status report on NRC licensing activities and regulatory duties for the second quarter in Fiscal Year 2023 in response to the revised requirements noted in the September 26, 2019, letter from the Committee on Environment and Public Works and Subcommittee on Clean Air and Nuclear Safety. This report reflects information for the reporting period of January 1, 2023, through March 31, 2023. provides a high-level graphical summary illustrating the NRC's overall performance in the areas of licensing, inspection activities, workforce development and management, and financial administration. Enclosure 2 provides the status of specific items of interest, including a summary of the item, the activities planned and accomplished within the reporting period, and projected activities for the next two reporting periods. Finally, Enclosure 3 provides data and additional information associated with the NRC's licensing activities and regulatory duties.

Last quarter, we reported that the final rule that certifies NuScale's small modular reactor design for use in the United States was published in the Federal Register on January 19, 2023.

The design certification's effective date was February 21, 2023. With this significant milestone completed, the NRC has removed the "NuScale Small Modular Reactor Design Certification,"

section from this report.
