UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 June 20, 2023 AGREEMENT STATES CONNECTICUT, INDIANA, WEST VIRGINIA NOTIFICATION OF REVISION TO INSPECTION MANUAL CHAPTER (IMC) 2800, MATERIALS INSPECTION PROGRAM (STC-23-044)

Purpose:

To inform the Agreement States of the issuance of a revision to the Office of Nuclear Material Safety and Safeguards Inspection Manual Chapter (IMC) 2800, Materials Inspection Program. IMC 2800 is a program element that is a matter of compatibility for the Agreement States. This letter provides additional information resulting from the Standing Committee on Compatibility review.

Background:

The U.S. Nuclear Regulatory Commission (NRC) formed a working group composed of NRC and Agreement State members to revise IMC 2800 and selected implementing inspection procedures to incorporate more risk and performance insights into the materials inspection program. This effort benefits from extensive inspection experience of the NRC and Agreement States members and is using previous materials inspection information, including enforcement issues, to support the changes. The first 10 inspection procedures were issued with an effective date of May 16, 2022, after addressing Agreement State comments.

Four additional inspection procedures were issued for Agreement State comment in June 2022 and will be issued in the summer of 2023. The draft revisions to IMC 2800 were provided to the Agreement States for comments on November 28, 2022, via RCPD-22-012. The working group appreciates the review of the draft guidance and has completed its comment resolution.

Discussion: The working group revised IMC 2800 to: incorporate a very low safety significance issue resolution process; provide guidance for inspection coordination for licensees undergoing or transitioning to decommissioning; incorporate recommendations from the COVID-19 pandemic lessons learned efforts including a new Appendix A, Inspection Program Modifications During Pandemics or Other Situations Impacting Travel to Perform Inspections, and defining the terms hybrid, onsite, and remote inspection; and emphasize the coordination and collaboration among the National Materials Program.

IMC 2800 is a matter of compatibility. The Standing Committee for Compatibility made the following determinations that apply to IMC 2800:

1. IMC 2800 and its implementing inspection procedures are a program element that are a matter of compatibility, designated as Compatibility Category C.
2. Agreement States should implement compatible inspection guidance within 1 year of the date of this letter.

Based on these determinations, Agreement States have 1 year from the date of this letter to conform inspection guidance, as appropriate, with the current version of IMC 2800.
