Hello, I am Chris Hanson, Chair of the Nuclear Regulatory Commission.

Thank you for joining us today to hear about our Tribal Program.

Within the United States, 574 federally recognized tribal nations currently exist as sovereign governments.

Additionally, there are tribes located throughout the United States recognized by State governments. These tribal communities have centuries of locally relevant experience and knowledge. At the NRC, we recognize their expertise and want to ensure they are involved in decisions affecting their Chair at his desk sitting and speaking into the camera.

Thats why the Commission held its first meeting in decades outside of Rockville when we met in Gallup, New Mexico about the remediation of legacy uranium mining and milling sites. We heard directly from tribal representatives, notably Jonathan Nez, president of the Navajo Nation, about how the NRC can best achieve its mission of protecting people and environment as it oversees cleanup at uranium mill sites.

Finding further opportunities to improve Tribal relationships and engagement is important to the work that we do as an agency.

CHAIR Hi Cathy! Cathy Haney is our Deputy Executive Director for Materials, Waste, Research, State, Tribal, Compliance, Administration and Human Capital Programs in the Office of the Executive Director for Operations.

I have asked Cathy to address the NMSS Tribal Program. First, could you speak about our Tribal Policy Statement?

3 CATHY Thank you, Chairman!

The NRC Tribal Policy Statement was developed to encourage and facilitate Tribal involvement in activities under NRC jurisdiction.

It provides guidance to ensure consistency across the agency in government-to-government relations with federally recognized Tribes.

The policy statement also underscores the NRC's commitments to conducting outreach to Tribes and engaging in timely consultation, and to coordinate with other Federal agencies.

Cathy is sitting and speaking into the camera.

Chairman The NRC Tribal Programs are integral part of the successful work that the NRC is doing with Tribal Nations. It is important that we are able to work with Tribes to meet our mission.

4 As a Native American I knew that the NRC worked with tribes, but I did not realize the scope and depth of the program. It has been so exciting to learn about the program and how the agency has made working with Tribal Nations a priority not only with all the tools but in the everyday work that is being done. I must think that there are a lot of folks at the NRC that really do not know about the outstanding job the Tribal Liaisons project managers are doing and the priority that leadership is making for these engagements.

Jessie, hi I have a couple questions for you. what is the history here on consultations? Why do we consult? What are other types of consultation?

Jessie Hi Candace. And sure, I can answer your questions about consultation. The Environmental Center of Expertise or COE is responsible for reviews under the National Environmental Policy Act (or NEPA) and other environmental regulations.

5 which requires us to consult with other parties such as Tribes, Tribal and State Historic Preservation Offices, and ACHP. The NRC often fulfills it Section 106 consultation through its NEPA reviews.

Through these reviews, we are evaluating the potential impacts to the environment on the actions we are reviewing and approving.

We consult with tribes on our activities to get their input on (1) identifying potential resources, including traditional cultural properties, that could be affected by licensee activities, (2) what those impacts could be and (3) what could be done to avoid or mitigation those potential impacts.

We consult with Tribes who may be affected directly by the activity as well as with Tribes who have ties to the land where an activity could occur.

Candace I have a strong belief that as we help staff learn about the Tribal Liaison Program and all that is being done it will continue to enhance our mission.

And I hope that in the future everyone at the agency will be able to engage with others in their everyday life and be able Video is back to Candace.

6 to communicate to them about the NRC mission to encourage and facilitate Tribal involvement in activities under all the NRC jurisdictions. And we will have changed the way the Federal Government engages Indian Tribes and we have upheld our Trust responsibility to Indian Tribes.
