SUMMARY

OF THE MARCH 30, 2023, CLOSED MEETING WITH NUSCALE POWER REGARDING CARBON FREE POWER PROJECT APPROACH FOR ADDRESSING PHYSICAL SECURITY REQUIREMENTS The U.S. Nuclear Regulatory Commission (NRC) staff held a closed meeting with NuScale Power, LLC (NuScale) and Carbon Free Power Project, LLC (CFPP) on March 30, 2023. The purpose of this meeting was for NuScale to present its approach for addressing regulatory requirements associated with CFPPs physical security program.

The closed meeting notice was posted on the NRC public website on March 23, 2023, and can be accessed on Agencywide Documents Access and Management System (ADAMS) Accession No. ML23082A085.

This meeting did not include a public (open) portion because the information presented by NuScale and discussed during the meeting were of security-related and proprietary nature.

During the meeting, NuScale stated that the presentation made during this meeting was a follow-up to the public meeting held on September 20, 20221. NuScale further stated that since the last public meeting, it had revised aspects of its approach to address the physical security requirements as set forth in 10 CFR 73.55, Requirements for physical protection of licensed activities in nuclear power reactors against radiological sabotage.

Topic areas discussed during the meeting included physical security requirements specified by 10 CFR 73.55; physical security systems, hardware, features, and technologies; target sets; table-tops and force-on-force exercises; and the physical security plan.

The NRC staff asked NuScale representatives if they anticipate submitting any exemption requests from the requirements in 10 CFR Part 73. In response, NuScale staff stated that they are still evaluating if NuScale would need an exemption from any requirements and that as the design matures, additional refinements to the approach might be needed.

At the conclusion of the meeting, the NRC and NuScale staff agreed to coordinate additional meetings in the future to discuss the details of CFPPs physical security program.
