SUBJECT:
CHARTER FOR IMPLEMENTATION OF KEY RECOMMENDATIONS FROM COVID LESSONS LEARNED WORKING GROUP This memorandum approves the team charter discussed in the memorandum, Disposition of Recommendations from the Follow-on Review of the Lessons Learned, Best Practices, and Challenges during the COVID-19 Public Health Emergency (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23086C029). This multi-office team, with representation from all four regional offices and headquarters staff, will ensure consistent implementation of the recommendations such that partner offices will be able to adopt similar modifications to their program documents. The team will develop, propose, and implement modifications to the following inspection manual chapters (IMCs) related to operating reactors:
IMC 2515, Light Water Reactor Inspection Program Operations Phase,
IMC 2901, Team Inspections, and
IMC 2515, Appendix E, Inspection Program Modifications During Pandemics, Epidemics, or Other Widespread Illnesses or Diseases As the working group develops changes to inspection documents, they shall adhere to these principles:
1.
Changes to improve efficiency shall not adversely impact effectiveness (e.g. hybrid inspection activities may be used only when they do not adversely impact inspection effectiveness).
2.
The BeRiskSmart framework shall be used in evaluating potential adverse impacts under principle #1. See https://usnrc.sharepoint.com/teams/Be-riskSMART and the BeRiskSmart evaluation in Appendices B and C of the Follow-On Review of Lessons-Learned, Best Practices, and Challenges During the Covid-19 Public Health Emergency report (ML22172A159).

The revisions should provide flexibility to the regions and promote decision-making at the lowest hierarchical level practicable (e.g., at the inspector or inspection team leader level) while also providing an appropriate level of reliability in implementation across regional offices.

Charter for Implementation of Key Recommendations from COVID Lessons Learned Working Group July 6, 2023 I.
Purpose The purpose of this charter is to staff a team of office representatives to implement key recommendations from the NRCs follow-on review of the lessons-learned, best practices, and challenges during the COVID-19 public health emergency (PHE). At the conclusion of the effort, the team will issue revisions to inspection manual chapters (IMCs) that incorporate the teams proposals for implementing the key recommendations.
II.
Background
The staff completed a follow-on review of the lessons learned, best practices, and challenges during the COVID-19 PHE in 2022 and documented the results in a memo, Final Report for the Follow-on review of the Lessons Learned, Best Practices, and Challenges during the COVID-19 Public Health Emergency, dated July 2022 (ADAMS Accession No. ML22172A159). The memo identified several recommendations associated with aspects of the NRCs inspection program. These recommendations were focused on three main areas including: 1) information technology (IT) capability and reliability; 2) hybrid inspection practices; and 3) inspection guidance enhancements.
Following a deliberation over the report by Regional and NRR management, four key recommendations were selected for implementation through the formation of this working group (See DISPOSITION OF RECOMMENDATIONS FROM THE FOLLOW-ON REVIEW OF LESSONS-LEARNED, BEST PRACTICES, AND CHALLENGES DURING THE COVID-19 PUBLIC HEALTH EMERGENCY, ADAMS ML23086C029).
Representatives from each inspection office will participate to ensure that the implementation of the recommendations will be standardized for the agency.
III.
Objectives This multi-office team, with representatives from all four regions and headquarters, will implement the following key recommendations, while adhering to the principles outlined in the memo approving this charter:
Revise IMC 2515, Appendix E, Inspection Program Modifications During Pandemics, Epidemics, or Other Widespread Illnesses or Diseases, to include direction for the program offices to identify consistent criteria, resources, evaluation methodology, and inspection prioritization for future events.
Adopt a standard definition of on-site, remote, and hybrid inspection between NRR, NSIR, and NMSS. The working group presented a proposed definition in the body of the report. Add the standard definition to IMC 2515, Light Water Reactor Inspection Program - Operations Phase.

Incorporate high level guidance, controls, and risk mitigation strategies (e.g., pre-planned and piloted use of technology) in IMC 2515 and 2901 that outline the use and limitations of hybrid inspection practices, to ensure inspections are effective and efficient.
Revise IMC 2515 and IMC 2901 to include guidance on when hybrid/virtual meetings (i.e., entrances and exits for routine inspections) may be beneficial for effectiveness and efficiency.
IV.
Proposed Actions Establish a team comprised of members from NRRs Division of Reactor Oversight (DRO), the Office of Nuclear Security and Incident Response (NSIR), the Office of Nuclear Material Safety and Safeguards (NMSS), and the four regional offices.
Leveraging the experience and perspectives of the participating offices, develop, propose, and implement modifications to the above IMCs based on the key recommendations of the Follow-on review of the Lessons Learned, Best Practices, and Challenges during the COVID-19 Public Health Emergency (ML22172A159).
V.
Scope Upon issuance of the revised IMCs, the working group will be disbanded.

VIII.
Meetings Team meetings will be scheduled bi-weekly during the development period. Meeting schedules will be adjusted as necessary. Once draft proposals have been developed, working group representatives will brief the Regional Administrators and Office Directors on the draft modifications to ensure early alignment of the working groups products.
These briefings should occur in early August shortly after development of the IMC proposals. Upon obtaining alignment with the Regional Administrators and Office Directors, the IMCs will begin the comment and issuing process for finalization.
IX.
Time Reporting All activities will be documented in HRMS using CAC A11018 or other office specific CACs for ROP program development (i.e. DSO - A11020).
