Dear Governor Gordon:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your February 21 , 2023, letter requesting that the NRC and the State of Wyoming establish an amended Agreement pursuant to Section 27 4b of the Atomic Energy Act of 1954, as amended (the Act). Under your request, Wyoming would assume regulatory authority over source material recovered from any mineral resources processed primarily for purposes other than obtaining source material content, in addition to the authority under the current Agreement. We appreciate your early communication on this matter. The NRC staff is available to provide guidance to the State of Wyoming in the development of the application for the amended Agreement.

As required by the Act, the NRG staff will conduct an assessment of the compatibility of the Wyoming program with the NRC's program and the adequacy of Wyoming's program to protect public health and safety. After its review, the NRG staff will provide the results of its assessment to the Commission . If the Commission approves, the NRG will publish a summary of the assessment along with the proposed amendment to the Agreement in the Federal Register for public comment. After the expiration of the comment period, the Commission will consider any comments received and make a final decision on the request. You will be notified promptly of the decision.

The Commission welcomes the State's interest in amending the Agreement and looks forward to continuing its collegial relationship with the State of Wyoming.
