On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your March 10, 2023, letter regarding the NRC's efforts to establish a regulatory framework for fusion energy systems. We appreciate your recognition of the effort the staff has undertaken to develop the regulatory options detailed in SECY-23-0001, "Options for Licensing and Regulating Fusion Energy Systems," dated January 3, 2023, 1 and for your continued engagement in providing information for the Commission's consideration.
The Commission recently approved the staff's option to regulate fusion energy systems under the NRC's byproduct material framework contained in Title 1O of the Code of Federal Regulations, Part 30, "Rules of General Applicability to Domestic Licensing of Byproduct Materials," and associated regulations. We encourage you and other stakeholders to stay engaged as the NRC staff embarks on a limited-scope rulemaking to implement this decision.
