2.206 Petition Related to the Storage of Spent Fuel Assemblies Date: Tuesday, March 14, 2023 4:05:00 PM Good afternoon Mr. Leyse, This e-mail is to inform you that I will be the Petition Manager for your February 28, 2023, petition. I will keep you informed of the status as the evaluation of your petition progresses. Please feel free to contact me with any questions about the process and/or the status of the petition review at any time.
In your petition you requested that the Nuclear Regulatory Commission (NRC) order licensees to promptly transfer all of the sufficiently-cooled spent fuel assemblies that are presently stored in each of the spent fuel pools at U.S. nuclear plants to dry cask storage.
The NRC staff has concluded that your petition has screened into the 2.206 process in accordance with Section II.A.2(d) of NRC Management Directive (MD) 8.11 Review Process for 10 CFR 2.206 Petitions (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18296A043) and a Petition Review Board has begun its evaluation.
Following evaluation in accordance with Sections II.B.1 of MD 8.11, the NRC staff has concluded that there is no imminent safety concern related to spent fuel pools that warrants immediate NRC action.
As the PRB performs its evaluation, I would like to ensure that you are aware that because the 2.206 petition process is a public process, the petition and all of the information in it, including your identity, will be made publicly available.
