As requested by your letter dated February 24, 2023 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML23059A032), enclosed is Certificate of Compliance No. 9362, Revision No. 4, for the Model No. DN30 package. The staffs safety evaluation report is also enclosed.

This approval constitutes authority to use the package for shipment of radioactive material and for the package to be shipped in accordance with the provisions of Title 49 of the Code of Federal Regulations 173.471.

SUMMARY

By letter dated February 24, 2023 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML23059A032), Orano NCS GmbH informed U.S. Nuclear Regulatory Commission staff that, due to the acquisition of Daher Nuclear Technologies GmbH (DNT) by Orano Nuclear Packages and Services (Orano NPS), the certificate of compliance USA/9362/AF-96 for the Model No. DN30 package that had been issued to DNT shall be transferred to Orano NCS GmbH.

Orano NCS GmbH is structured within Orano NPS and remains an independent legal entity.

Orano NCS GmbH holds an established quality assurance program and implementing procedures for compliance to Title 10 of the Code of Federal Regulations (10 CFR) Part 71, Packaging and Transportation of Radioactive Material, and 10 CFR Part 21, Reporting of Defects and Noncompliance under Docket No. 71-0951.

The certificate has been issued to Orano NCS GmbH. The expiration date of the certificate was not changed.

EVALUATION The certificate holder has been changed from Daher Nuclear Technologies GmbH to Orano NCS GmbH. Orano NCS GmbH accepts responsibility for the completeness and accuracy of the statements and representations of the previous certificate holder.

Orano NCS GmbH will be responsible for maintenance of the certificate and safety analysis report of the package design in accordance with the requirements of 10 CFR 71.91(c).

Revision No. 4 of this certificate supersedes Revision No. 3 in its entirety.

CONDITIONS Item No. 1.b, Revision Number, was updated to Revision No. 4.

Item No. 3(a) was modified to include the name of ORANO NCS GmbH as certificate holder.

Condition No. 11, extending the previous revision of the certificate, was deleted.

Condition No. 12 was renumbered No. 11. The expiration date of the certificate was not changed.

CONCLUSION The staff concludes that the changes indicated do not affect the ability of the package to meet the requirements of 10 CFR Part 71.
