LOUISIANA ENERGY SERVICES, LLC, - AMENDMENT 97, APPROVAL OF URENCO USA EXECUTED TRUST AGREEMENT FOR DECOMMISSIONING (ENTERPRISE PROJECT IDENTIFIER L-2022-DFA-0011)

Dear Wyatt Padgett:

The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed Urenco USA (UUSA) executed financial assurance instruments for decommissioning submitted via letter LES-22-154-NRC dated December 13, 2022 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML22354A126). UUSA requests approval of an implemented decommissioning trust agreement and authorization to execute changes to existing decommissioning funding assurance vehicles. The NRC authorizes the implementation of the external sinking fund method using the decommissioning trust identified in this review.

Pursuant to Part 70 of Title 10 of the Code of Federal Regulations (10 CFR), Materials License SNM-2010, Condition 10 is hereby amended to read as follows:

10. af Decommissioning Financial Assurance submitted by letters dated December 12, 2019 (ML19351C772), October 12, 2020 (ML20296A196), April 1, 2021 (ML21109A186),

December 15, 2021 (ML22063A481), and December 13, 2022 (ML22354A126).

The review by the NRC staff is documented in the safety evaluation report, which is provided as to this letter. Enclosures 2 and 3 to this letter provide publicly available and non-publicly available versions of the amended Materials License SNM-2010, respectively. This letter concludes action on this submittal and Enterprise Project Identifier L-2022-DFA-0011.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter and the non-sensitive portions of the enclosures will be available electronically for public inspection in the NRC Public Document Room (PDR) or from ADAMS. transmitted by this letter contains Proprietary Information and Enclosure 3 contains Security-Related Information.

When separated from Enclosures 1 and 3, this letter and Enclosure 2 are decontrolled.March 8, 2023 OFFICIAL USE ONLY - PROPRIETARY INFORMATION W.
