The National Institute of Standards and Technology (NIST) applied for a license amendment via a letter dated February 1, 2023. The purpose of the amendment is to revise the National Bureau of Standards Reactor (NBSR), Safety Analysis Report, as necessary to describe an alternative fuel management scheme and associated analytic methods. The proposed amendment does not change existing license conditions including the technical specifications.

NIST provided a no significant hazards consideration (NSHC) determination, with the license amendment request. The NRC staff determined the NSHC to be consistent with the regulatory requirements and sufficient to support the amendment request involved NSHC. The application was originally noticed in the Federal Register (FR) on February 10, 2023 (88 FR 8918).

Please let me know if you have any comments on the NSHC or pending license amendment for the NIST reactor.

Additionally, as a result of the event on February 3, 2021, NIST identified that the NBSR exceeded its safety limit. Per the regulation in Title 10 of the Code of Federal Regulations section 50.36 Technical specifications, paragraph (c)(1) If any safety limit is exceeded, the reactor must be shutdown... [and] operation must not be resumed until authorized by the Commission. NIST has reviewed the event, proposed, and completed all necessary corrective actions and actions necessary to prevent recurrence. The NRC staff has inspected the facility to confirm its readiness to restart and completed a technical evaluation of the facility condition. The NRC is preparing to make a restart determination regarding the ability of NIST to resume operations of the NBSR.
