Dear Mr. Warden:
Enclosed is an application (XB1363) dated January 20, 2023, received by the U.S. Nuclear Regulatory Commission (NRC), from Eckert & Ziegler Isotope Products, is requesting to export a total four byproduct material sources to Belarus and Russia. The sources range in activity levels from 0.1 to 55 Megabecquerels (MBq) and are used to calibrate medical imaging devices.
Ordinarily, this export would be authorized under the General License provisions in Title 10 of the Code of Federal Regulations (10 CFR) Part 110.23. However, in May 2022, the Biden Administration determined that continued exports to Russia pursuant to existing NRC general licenses would be inimical to the United States common defense and security, and that suspension of general license exports to Russia would be necessary to further U.S. national security interests. Consistent with this determination, the NRC issued an Order suspending all exports under a general license to the Russian Federation. In keeping with existing processes for specific export licensing requests, NRC staff is seeking Executive Branch (EB) review and an inimicality determination for this request.
Before acting on this request, we appreciate your views on this application, in accordance with 10 CFR Part 110.41, from the overall perspective of the EB, as to whether the requested export meets the applicable criteria in the Atomic Energy Act of 1954, as amended.
