NRC Staff RIC Review Checklist Introduction This document provides a checklist for staff reviewing presentations and digital exhibits for the Regulatory Information Conference (RIC). The checklist is for staff to use to determine if OGC review of RIC presentations and digital exhibits is necessary.

How to Use This Checklist Use the checklist to determine if OGC review and NLO is necessary for RIC presentations and digital exhibits. The staff reviewer should review each item in the checklist to ensure the content of the presentation or digital exhibit does not include information falling into any of the categories listed below. If the staff reviewer determines that the presentation or digital exhibit contains information falling into one of the categories below, or has a question about the information below, then an OGC review and NLO determination is necessary. If the staff reviewer determines that the presentation or digital exhibit does not contain the information listed below or with respect to copyright-protected information, that the appropriate permissions have been obtained, then OGC review is not required.

If OGC review is not required, the staff reviewer should complete the information at the bottom, save, and send the completed checklist to OGC_RICReview@nrc.gov for record keeping purposes.

Note that the presentation, talking points, or digital exhibit should include a disclaimer that the presentation or digital exhibit does not present the views of the NRC.

Checklist:

Copyright - The presentation or digital exhibit does not contain quotations, pictures, graphics, codes, or links to materials that are subject to copyright, or permission from the copyright holder has been obtained.

o Images and graphics from NRC social media postings and publications are acceptable. Quotations from NRC publications are also acceptable.

o If a question arises on whether the use of copyrighted material falls under the fair use doctrine, please seek OGC advice.

o Note: simply because the quotation, picture, graphic, code, or publication was found online does not mean that the material is not copyrighted.

Adjudicatory ProceedingsThe presentation or digital exhibit does not contain information regarding ongoing adjudicatory proceedings before either the ASLBP, Commission, or federal courts.

Non-promotionalThe presentation or digital exhibit does not promote or take a promotional stance regarding the use of nuclear power or nuclear materials.

Personally Identifiable Information (PII)The presentation or digital exhibit does not contain PII.

Controlled Unclassified Information (CUI) and Sensitive Unclassified Non-Safeguards Information (SUNSI)The presentation or digital exhibit does not contain information derived from CUI or SUNSI marked sources.

Non-Public InformationThe presentation or digital exhibit does not contain any non-public information (e.g.,

rulemaking options that have not yet been released to the public, predecisional information, unreleased drafts, etc.).
