STC UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 ALL AGREEMENT STATES, CONNECTICUT, INDIANA, WEST VIRGINIA NOTIFICATION OF THE ISSUANCE AND OPPORTUNITY TO COMMENT ON THE U.S. NUCLEAR REGULATORY COMMISSION PROPOSED RULE, ALTERNATIVES TO THE USE OF CREDIT RATINGS, (STC-23-006)

Purpose:

To provide Agreement States the notice and opportunity to comment on the published proposed rule, Alternatives to the Use of Credit Ratings, and related guidance.

Background:

The U.S. Nuclear Regulatory Commission is proposing to amend its regulations for approved financial assurance mechanisms for decommissioning, specifically for parent and self-company guarantees that require bond ratings issued by credit rating agencies. This proposed rule would implement the provisions of the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 that directed agencies to amend their regulations to remove any reference to or requirement of reliance on credit ratings. This proposed rule affects applicants and licensees who are required to provide decommissioning financial assurance.

Discussion: The proposed rule was published on January 3, 2023, and is posted in the Federal Register (FR), (88 FR 25). The Agreement States may submit comments on the draft regulatory guidance by the methods outlined in the ADDRESSES section of the FR. You can also access this proposed rule in Regulations.gov by clicking on the docket number in the Regulations.gov box in the link above. Please provide comments by March 20, 2023.

The Standing Committee on Compatibility reviewed the proposed rule and determined that the provisions in Title10 of the Code Federal Regulations parts 30, 40, and 70 of this rulemaking are a matter of compatibility with the Agreement States. However, since these regulations are designated as a D compatibility category the Committee determined that the Agreement States do not have to adopt these provisions for compatibility purposes.
