OF THE NOVEMBER 29, 2022, PUBLIC MEETING TO DISCUSS THE UNIVERSITY OF ILLINOIS AT URBANA-CHAMPAIGN PLANNED TOPICAL REPORTS SUBMITTALS On November 29, 2022, (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML22321A095) the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting for the University of Illinois at Urbana-Champaign (UIUC) staff to provide an overview of the planned topical reports (TRs) pertaining to the applicability of NRC regulations and fuel qualification. Specifically, the UIUC staffs discussion (ML22335A481) focused on:
1.
A high-level design description of the Micro-Modular Reactor planned to be deployed at the UIUC campus, such as a planned power level of approximately 10 MWt.
2.
UIUCs process for determining the applicability of NRC regulations to the UIUC reactor project and to determine any exemptions in the associated TR.
3.
Familiarizing the NRC staff with UIUCs forthcoming Fuel Qualification Topical Report submittal.
The NRC staff asked clarification questions to better understand the scope of the approval requests for both TRs and to provide feedback pertaining to any approval limitations should the TR be found acceptable by the NRC staff (e.g., the exemptions assessment will not be part of the TR review). After the business portion of the meeting, members of the public asked several questions to the NRC staff. This included a question pertaining to the NRC staffs ability to approve a construction permit and/or operating license for the UIUC proposed reactor given Illinois States moratorium on new nuclear power plant construction.

M. Wentzel The NRC staff indicated that an application for a construction permit, if submitted to the NRC, would be reviewed by the NRC staff in accordance with the Atomic Energy Act of 1954, as amended, and the NRCs applicable regulations. Any State laws and requirements associated with the proposed construction of the facility would be handled separately between UIUC and the State of Illinois.
