DIABLO CANYON POWER PLANT, UNITS 1 AND 2 - EXEMPTION FROM THE REQUIREMENTS RELATED TO SUBMISSION OF A LICENSE RENEWAL APPLICATION

Dear Paula Gerfen:

In response to your letter dated October 31, 2022, the U.S. Nuclear Regulatory Commission (NRC) has granted the enclosed exemption from a specific requirement of Title 10 of the Code of Federal Regulations, Section 2.109(b), for Diablo Canyon Power Plant, Units 1 and 2.

Pursuant to this exemption, if Pacific Gas and Electric submits a license renewal application no later than December 31, 2023, and if the NRC Staff finds it acceptable for docketing, the existing operating licenses for Diablo Canyon Power Plant, Units 1 and 2 will be in timely renewal under NRC regulations until the NRC has made a final determination on the license renewal application.

A copy of the exemption is enclosed. The exemption has been forwarded to the Office of the Federal Register for publication.

In accordance with Title 10 of the Code of Federal Regulat ions (10 CFR) Part 2, Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs Agencywide Documents Access and Management System (ADAMS).
