Dear Senator Barrasso:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your January 9, 2023, letter requesting that the NRC promptly review the license application submitted by Rare Element Resources to possess naturally occurring radioactive material resulting from domestic rare earth element processing.

The NRC staff is currently conducting its detailed technical review of the application. The staff anticipates completing the safety and environmental reviews and making a licensing decision by July 2023. This projected completion date is based on the staff receiving sufficient and timely responses to any requests for additional information. If additional information is required for completing the review, the staff plans to send the request in an expeditious manner and will continue to keep Rare Element Resources informed as it proceeds through its review.
