OF DECEMBER 15, 2022, MEETING WITH THE NUCLEAR ENERGY INSTITUTE - SPENT FUEL ACTIVITIES AND PRIORITIZATION

Background

On December 15, 2022, the staff of the U.S. Nuclear Regulatory Commission (NRC) conducted a hybrid public meeting (in-person and virtual via Microsoft Teams) with representatives of the Nuclear Energy Institute (NEI), nuclear fuel storage and transportation industry representatives, and members of the public. The purpose of the meeting was to discuss the status of priorities in the spent fuel arena between the NRC and industry. The meeting was noticed in the NRCs public website as an Observation meeting (ADAMS Accession No. ML22347A208). Enclosure 1 includes the list of participants. Enclosures 2 and 3 include the presentation slides from NEI and the staff, respectively. No regulatory decisions or commitments were made during the meeting.

Discussion The NRC staff opened the meeting by highlighting the importance of high-quality applications for licensing reviews, the NRCs focus on recruitment, hiring, and staff qualification and training, continuing to apply lessons-learned and risk-informed insights to our programs, and the need for future engagement on spent fuel storage and transportation packages that will be needed to support deployment of accident tolerant and advanced reactor fuels. The NRC staff then discussed its priorities, accomplishments, and current activities to risk-inform spent fuel reviews (See Enclosure 3).

Zimmerman 2 Following NRCs presentation, NEI proceeded with their presentation and noted that some progress has been made, since the last meeting related to priorities and enhancements in the spent fuel arena. Some of the topics that NEI covered in their presentation included their vision of success, their ongoing actions including fuel integrity metrics, risk tool implementation, and graded approach, criticality recommendations, operational and administrative controls related to storage systems, new or emergent topics including modernizing inspection processes, and on topics related to accident tolerant fuels, high burn up fuel, and low enriched uranium plus (LEU+) as these become increasingly used.

Meeting participants shared feedback about some of the risk-informed efforts that have been pursued over the past few years such as the risk tool (ADAMS Accession No. ML20324A110),

the graded approach (ADAMS Accession No. ML19353D337), and the thermal topical report (ADAMS Accession No. ML21302A147).

The industry shared their plans for continued focus on risk-informed efforts. The NEI representative indicated that the industry plans to develop guidance or a topical report to capture insights from Phenomena Identification and Ranking Tables (PIRTS). The NRC staff noted that early engagement on these topics will be beneficial for all parties and encouraged industry to focus on those areas with the greatest impact on safety.

The NRC suggested that industry prioritize the initiatives to be submitted for NRCs review, so that NRC may consider how to factor additional efforts into existing workload and priorities.

NRC discussed the letter issued on December 14, 2022 (ADAMS Accession No. 22339A180) and its efforts to draft a regulatory guide to endorse NEI-22-02, Guidelines for Weather-Related Administrative Controls for Short Duration Outdoor Dry Cask Storage Operations, with clarifications and exceptions as needed. The staff plans to finalize the regulatory guide several months prior to the 2024 expiration of the Enforcement Guidance Memorandum (EGM)

(ADAMS Accession No, ML22087A496). In the interim, the staff will continue to review license amendments that are submitted by certificate of compliance holders.

NRC staff also mentioned the recently-enhanced ISFSI inspection program and that it will continue to monitor the program and is in the process of evaluating its effectiveness after the first year of implementation. The staff will share the outcome of the assessment and any improvements identified.

Then, the presenters turned over to answer a few questions from the audience.
