ALL AGREEMENT STATES, CONNECTICUT, INDIANA NRC NMSS, NRC REGIONS I, III, AND IV NOTIFICATION OF ISSUANCE AND OPPORTUNITY TO COMMENT ON THE INTERIM STATE AGREEMENT (SA) PROCEDURE, SA-400, MANAGEMENT OF AGREEMENT STATE PROGRAM PERFORMANCE CONCERNS (STC-22-070)

Purpose:

To provide the National Materials Program (NMP) community an opportunity to comment on, and use the interim procedure, SA-400, Management of Agreement State Program Performance Concerns.

Background:

The U.S. Nuclear Regulatory Commission (NRC) last issued SA-400 in January 2001. Proposed revisions to SA-400 were issued to the Agreement States for comment in 2011, 2015 and 2021. This revision of SA-400 was updated to reflect current practices and clarifies NRC and Agreement State staff roles and responsibilities.

Discussion: This letter notifies the NMP community that NMSS procedure SA-400 has been prepared and issued for use on an interim basis (6 months from date of this letter), to allow Agreement State and NRC staff to provide comments1 based on their review and implementation of the procedure. If there are no comments for this procedure, the procedure will be automatically finalized without any further action. Please provide comments to the contact person listed below.

This procedure has been uploaded to the NRCs public website for use, and for review and comment: https://www.nrc.gov/reading-rm/doc-collections/nmss-procedures/state-agreement.html. The procedure can be also found in ADAMS under Accession No. ML22243A239.
