Just wanted to follow up with you regarding your compliance with 32 CFR 117.10(a)(7). Based on our conversation yesterday it is my understanding that you are not able to comply with that regulation due to a conflict with DOE orders. I did verify that although you have conflicting requirements you are still held to both of them. I believe a waiver would be required for this regulation. I do not anticipate any issues with the NRC granting that waiver.
