Docket No. 70-143-LA ASLBP No. 23-976-01-LA-BD02 November 22, 2022 MEMORANDUM AND ORDER (Tentative Initial Prehearing Conference Schedule)
Based on the information provided by the participants in response to the Licensing Boards November 9, 2022 issuance,1 and contingent on the Boards decision to hold the conference, an initial prehearing conference for this proceeding concerning the pending BWXT Nuclear Fuel Services, Inc., (NFS) 10 C.F.R. Part 70 license amendment application is tentatively scheduled for Monday, December 12, 2022, beginning at 1:00 p.m. Eastern Time.
This conference will be for the principal purpose of conducting an oral argument regarding any disputes over standing or the admissibility of petitioner Erwin Citizens Awareness Network, Inc.s (ECAN) four proffered contentions challenging various aspects of NFSs license amendment application to perform uranium purification and conversion services at its Erwin, Tennessee nuclear fuel fabrication facility.

As was noted in our prior issuance,2 if the conference is held, it will be conducted virtually using the Cisco WebEx web conferencing platform. Once a Licensing Board decision is made to move forward with the initial prehearing conference, the Boards law clerk, Noel Johnson, will contact the participants counsel by e-mail to (1) schedule a test session conducted by the Licensing Board Panels Information Technology staff to identify and mitigate any technical issues concerning access to the conference; and (2) provide information about accessing the Cisco WebEx web conference by the participants counsel.
The participants are advised that the Board will provide an additional issuance regarding its decision to hold an initial prehearing conference. Further, if the Board decides to hold the conference, an additional memorandum (or memoranda) will confirm the date, supply listen-only call-in information for the public and interested parties, provide procedural information about the conference, and furnish information to the participants counsel about any particular questions or issues they should be prepared to address during the conference.
