CCN 22-83 November 8, 2022 U.S. Nuclear Regulatory Commission ATTN: Document Control Desk Washington, DC 20555-0001 Peach Bottom Atomic Power Station, Units 2 and 3 Subsequent Renewed Facility Operating License No. DPR-44 and DPR-56 NRC Docket No. 50-277 and 50-278

Subject:

Response to NRC Inspection Report and Preliminary White Finding

Reference:

Letter from D. Collins (U.S. NRC Region I) to D. Rhoades (Constellation Energy Generation, LLC), Peach Bottom Atomic Power Station, Units 2 and 3 - Integrated Inspection Report 05000277/2022003 and 05000278/2022003 and Preliminary White Finding and Apparent Violation, dated October 27, 2022 In the referenced letter, the NRC documented a preliminary White finding related to an event involving a Unit 2 scram which occurred in May 2022. Constellation Energy Generation, LLC (CEG) acknowledges the description surrounding the event discussed in the referenced letter.

The referenced letter requested verbal or written notification within 10 days of the date of the letter regarding CEGs intention to (1) request a regulatory conference to present to the NRC CEGs perspective on the facts and assumptions used to arrive at the finding and assess its significance, or (2) submit CEGs position on the finding to the NRC in writing.

On November 4, 2022, Ron DiSabatino (Plant Manager) verbally notified NRCs Jon Greives of CEGs decision to not contest the violation or significance of the violation. This letter confirms that CEG is not requesting a regulatory conference on this matter and will not be submitting a written response. It is understood by CEG that by declining to submit a written response or to arrange a regulatory conference, the preliminary assessment of significance will become final.

There are no regulatory commitments contained in this letter. Should you have any questions regarding this matter, please contact Wade Scott at (717) 456-3047.

Respectfully, David A. Henry Site Vice President Peach Bottom Atomic Power Station
