Request for Public Access to ASME Code Cases During Public Comment Period Date: Wednesday, October 12, 2022 6:03:17 PM Attachments: ASME Code Cases to be Incorporated by Reference.docx Ms. Kate Hyam Director of Nuclear Codes and Standards The purpose of this email is to request that the American Society of Mechanical Engineers (ASME) provide public access for a short time to the attached Nuclear Components Code Cases in Sections III and XI of the Boiler and Pressure Vessel (BPV) Code and Code Cases in the Operation and Maintenance (OM) Code during the public comment period.

In the near future, the U.S. Nuclear Regulatory Commission (NRC) would propose to approve these Code Cases for use in a rulemaking amending § 50.55a of Title 10 of the Code of Federal Regulations, Codes and standards. The NRCs approval of these Code Cases would be accomplished by a rulemaking incorporating by reference the NRCs Draft Regulatory Guide (DG)-1405, DG-1406, and DG-1407 (corresponding, respectively, to Regulatory Guide (RG) 1.84, Revision 40, RG 1.147, Revision 21, and RG 1.192, Revision 5), which would identify these Code Cases as newly approved for use. We are requesting that ASME provide members of the general public with read-only access to these Code Cases during the comment period for the proposed rule.

The planned target date for publication of the proposed code case rule is 3/15/23 for a 60 day public comment period (3/15/23-5/15/23). Please note the schedule is subject to change. No later than 30 calendar days before the planned publication date, NRC staff will contact you with an update on the schedule and to make final arrangements.
