COMPUTER ACCESS AND OPERATING AGREEMENT This agreement is made between the Nuclear Regulatory Commission (NRC) and PSEG Nuclear LLC (PSEG Nuclear) on behalf of itself and its co-owners for the purpose of providing the NRC with access to certain of PSEG Nuclear's computer databases.
WHEREAS, PSEG Nuclear desires to enhance the NRC's ability to perform its regulatory functions with respect to the Salem and Hope Creek generating stations by providing the NRC with access to certain computer hardware, software, and data bases owned by PSEG Nuclear and its co-owners and under PSEG Nuclear's control so that data needed for NRC inspection activities may be electronically accessed in a timely manner; and, WHEREAS, PSEG Nuclear is willing to make available to the NRC certain computer hardware, software, and databases as appropriate or otherwise necessary for the NRC to continue to perform its regulatory responsibilities subject to the terms stated below:
NOW, THEREFORE, in consideration of the covenants and conditions set forth below, the parties mutually agree as follows:
- 1.
At no charge, PSEG Nuclear will only make available and maintain for the NRC Resident Inspector's office at PSEG Nuclear a personal computer and associated hardware and the following software and databases necessary for the NRC to access PSEG Nuclear information that the NRC requires to fulfill its regulatory responsibilities:
- a.
Standard software provided at all PSEG Nuclear business unit local area computer terminals, including basic office automation tools, but from time to time not limited to, an electronic mail system, and word processing, spreadsheet and database, software compatible with the operating system.
- b.
Access to maintenance planning and corrective action program databases.
- c.
Software and databases for use in key word searching PSEG Nuclear redcords such as procedures, engineering documents, licensing documents, and nuclear industry documents.

The software and databases referred to above will be available to the NRC through "view only" access with no data modification capability and no control over the associated software programs. However, the NRC will
have the capability to print out and/or to save to external media such data as may be retrievable from the above databases.
- 3.
PSEG Nuclear acknowledges that all communications that are part of the formal licensing process will continue to be accomplished in a format consistent with the relevant regulations contained in Title 10 of the Code of Federal Regulations.
- 4.
The NRC acknowledges that all data and any hard copy printouts of such data made available to the NRC pursuant to this Agreement are "owned" and under the "control" of PSEG Nuclear, and that the NRC will treat such information as proprietary to PSEG Nuclear unless deemed otherwise.
However, any data that the NRC reduces to hard copy printout or transfers to a computer or disk in an NRC Resident Inspector's Office is considered an agency record under Federal law. In the event that a request is received by the NRC for any PSEG Nuclear information residing on NRC hard drives or in the NRC's possession, in hard copy or electronic form, prior to any public release NRC will provide PSEG Nuclear the opportunity to request that the information be withheld from public disclosure based upon its proprietary nature by executing an affidavit in accordance with agency regulation 1 0CFR §2.390.
- 5.
The term of this agreement shall remain in effect until and unless cancelled by either PSEG Nuclear or the NRC. Any such cancellation by either Party must be in written and provide at least thirty (30) days notice to the Counterparty before taking effect.
