STIPULATION OF VOLUNTARY DISMISSAL OF PETITIONER PUBLIC CITIZEN, INC. PURSUANT TO FEDERAL RULE OF APPELLATE PROCEDURE 42(b)
Petitioners Dont Waste Michigan, Citizens Environmental Coalition, Citizens for Alternatives to Chemical Contamination, Nuclear Energy Information Service, Public Citizen, Inc., San Luis Obispo Mothers for Peace, and Nuclear Issues Study Group; Petitioner Beyond Nuclear; Petitioner Sierra Club; Petitioners Fasken and PBLRO (collectively, Petitioners); Respondents United States Nuclear Regulatory Commission and United States of America; and Respondent-Intervenor Holtec International (collectively, Respondents) agree to dismiss Petitioner Public Citizen, Inc., from Case No. 20-1225 pursuant to Federal Rule of Appellate Procedure 42(b).
Petitioners and Respondents hereby inform the Court that as to Public Citizen, Case No. 20-1225 involves a Petition for Review of final Nuclear Regulatory Commission action. Further, Public Citizen, Inc. has expressed its desire to terminate its involvement in this matter. Accordingly, Petitioners voluntarily dismiss the aforementioned Petition for Review as to Public Citizen, Inc., only.
WHEREFORE, Petitioners and Respondents hereby stipulate and agree to the voluntary dismissal of the Public Citizen, Inc., only, pursuant to Federal Rule USCA Case #20-1225 Document #1970163 Filed: 10/22/2022 Page 2 of 4
of Appellate Procedure 42(b). Each party shall bear its own costs.
