Before the Licensing Board is the request of Park Overall for access to non-public Sensitive Unclassified Non-Safeguards Information (SUNSI) associated with the November 18, 2021 request of BWXT Nuclear Fuel Services, Inc., to amend the existing 10 C.F.R. Part 70 license for its Erwin, Tennessee nuclear fuel fabrication facility to perform new processes associated with uranium purification and conversion to uranium metal. The Board is in receipt of a letter dated October 5, 2022, from Ms. Overall.1 In that letter, she responds to certain aspects of the NRC Staffs October 3, 2022 reply to her September 28, 2022 appeal from the Staffs September 21, 2022 denial of her September 12, 2022 SUNSI access request.

While we are aware of Ms. Overalls status as a self-represented litigant, the Board nonetheless observes that the Commission directive that governs participant submissions in this

proceeding does not authorize a filing such as that made by Ms. Overall.2 Nor was her letter accompanied by a motion for leave to file such an additional submission.3 Accordingly, the NRC Staff need not submit any further responsive pleadings. If, however, the Staff wishes to do so, any Staff response to Ms. Overalls October 5 submission must be filed on or before Friday, October 7, 2022.

Thereafter, no further submissions are authorized in this proceeding in the absence of a participant motion seeking leave of the Board to file an additional pleading or a Board order requesting such a filing.

It is so ORDERED.
