Applicants Notice Regarding the Conduct of Discovery Entergy Nuclear Operations, Inc., Entergy Nuclear Palisades, LLC, Holtec International, and Holtec Decommissioning International, LLC, (the Applicants) submit this notice to ensure clarity among the parties and Board regarding the conduct of discovery in this proceeding.

On September 13, 2022, the Michigan Attorney General filed its First Discovery Request (ML22256A055) requesting production of certain categories of documents. Without waiving any objections or conceding the relevance or existence of any of the particular categories of documents requested, and consistent with Applicants obligation under 10 CFR 2.336(a)(2) and the Boards Order of August 31, 2022 (Board Order), Applicants intend to produce the requested information, to the extent it exists, is in Applicants custody or control, is not privileged, and is subject to disclosure under 10 CFR 2.336(a).

Consistent with 10 CFR 2.336(g), Applicants respectfully object to and do not intend to provide any narrative response to the Attorney Generals discovery request, for example, listing specific objections or limitations to each enumerated request. Further, Applicants disclosure on 1

October 14, 2022, will not identify with particularity which documents may be responsive to the specific categories listed in the Attorney Generals filing.

Applicants have conferred with counsel for the Attorney General to discuss this filing and the form of disclosures Applicants will make on October 14, 2022.
