Dear Mr. Smith:

The Advisory Council on Historic Preservation (ACHP) has recently received inquiries regarding the referenced undertaking and the Nuclear Regulatory Commissions (NRCs) compliance with Section 106 of the National Historic Preservation Act (NHPA) [54 U.S.C. 306108] and its implementing regulations, Protection of Historic Properties (36 C.F.R. part 800). We are aware that on August 22, 2022, the NRC published a notice in the Federal Register (Vol. 87, No. 161) regarding receipt of an application for a license amendment to allow for decommissioning and dismantling of Three Mile Island Unit 2 (TMI-2).

Though the ACHP was informally copied on several emails over the last year referencing this undertaking, the ACHP has no record of formal notifications about this undertaking or determinations of adverse effects to historic properties. There also appears to be uncertainty about the nature of Section 106 review that NRC intends to carryout. Therefore, we would appreciate you apprizing us of the current status of this project, including steps the NRC has or will be taking to comply with the requirements of Section 106.
