1 U.S. Nuclear Regulatory Commission Summary of the September 13, 2022, Observation Public Meeting to Discuss Carbon Free Power Project Preapplications Early Construction and Plans for Submitting Limited Work Authorizations Meeting Summary The U.S. Nuclear Regulatory Commission (NRC) staff held an observation public preapplication meeting on September 13, 2022, with NuScale Power, LLC (NuScale) and Carbon Free Power Project, LLC (CFPP) to get an overview of CFPPs plans for early construction activities and to submit limited work authorizations (LWA) to the NRC for review and approval. This public meeting also included a closed portion to allow participants to discuss proprietary information, including CFPPs project schedule and the scope of planned early construction and LWA activities. This virtual meeting had attendees from the NRC, NuScale, CFPP, Fluor, Rizzo International, Xcel Energy, Beyond Nuclear, Department of Energy (DOE), Uranium Watch, S&P Global, Breakthrough Institute, Hogan Lovells, and members of the public.
NuScale/CFPP started the meeting by describing the importance of early construction and requests for NRC approval of the necessary limited work authorizations in maintaining the schedule and commercial operation date of the first module of the CFPP project. CFPP has publicly announced that it plans to generate electricity using NuScale small modular reactor design beginning in 20291.
NuScale/CFPP stated that it is following the regulations in Title 10 of the Code of Federal Regulations 52.80(b) for combined licenses, and that it is using NUREG-1555, Standard Review Plan for Environmental Reviews for Nuclear Power Plants: Environmental Standard Review Plan, Regulatory Guide (RG) 1.206, Applications for Nuclear Power Plants, RG 4.2, Revision 3, Preparation of Environmental Reports for Nuclear Power Stations, and COL/ESP-ISG-026, Interim Staff Guidance on Environmental Issues Associated with New Reactors.
NuScale/CFPP also discussed the need for DOE and NRC to address National Environmental Policy Act requirements. Members of the public attending the meeting asked about the timeline for NuScales LWA submittals and the staff responded that such information is considered proprietary and business sensitive. Other questions from members of the public included whether there would be an opportunity for public comment or requests for hearing. Mr. Robert Taylor, Deputy Director for New Reactors at the NRCs Office of Nuclear Reactor Regulation, explained the NRC process for the review of an LWA and opportunities for public participation in the process as well as the mandatory hearing that is required to be conducted.
During the closed portion of the meeting, NuScale/CFPP provided an overview of the initial scope of the LWAs and the proposed timelines for submitting them to the NRC. The NRC staff asked if the NuScale/CFPP schedules for submitting LWAs considered mandatory hearings and the staffs need to develop environmental impact statements for each LWA as part of the staffs review. NuScale/CFPP responded that they are still working on adjusting the scope and schedules for submitting their LWAs to support the target date for submitting the combined 1 https://www.cfppllc.com/
2 license application, which is currently publicly available and planned for January 2024.
NuScale/CFPP stated that they will develop a more detailed plan that will clearly describe the timelines for the staffs safety reviews, environmental reviews, and conducting mandatory hearings and will share with the NRC staff at a future public meeting.
