REVIEW OF NEI 15-09, CYBER SECURITY EVENT NOTIFICATIONS, REVISION 1, DATED MAY 2022

Dear Mr. Mogavero:

In your letter dated June 2, 2022, you requested that the U.S. Nuclear Regulatory Commission (NRC) staff review and endorse the Nuclear Energy Institutes (NEIs) guidance document NEI 15-09, Cyber Security Event Notifications, Revision 1, dated May 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22154A296). NEI submitted this revision in part to make conforming changes following NRC acceptance for use of NEI 10-04, Identifying Systems and Assets Subject to the Cyber Security Rule, Revision 3, dated October 2021 (ML21342A168).

The NRC staff reviewed the draft document based on the requirements of Title 10 of the Code of Federal Regulations (10 CFR) 73.54, Protection of digital computer and communication systems and networks; 10 CFR 73.77, Cyber security event notification; prior staff positions; and feedback from a public meeting on the revisions held on August 10, 2022 (ML22241A080).

The staffs comments on NEI 15-09, Revision 1, are provided in the enclosure. If NEI revises and resubmits NEI 15-09 for review and the staff determines it is acceptable for use, the staff will document its approval in Regulatory Guide 5.83, Cyber Security Event Notifications.
