Dear Senator Schumer:

On behalf of the U.S. Nuclear Regulatory Commission (NRC) , I am responding to your August 30, 2022 , letter urging the scheduling of a public meeting with the Lower Hudson Valley communities and consideration of issues related to the NRC's proposed rule on regulatory improvements for production and utilization facilities transitioning to decommissioning. You and your colleagues also expressed concerns about transparency and public engagement by the agency on the current decommissioning of Indian Point.

With respect to future public meetings with the Lower Hudson Valley communities, the NRC staff plans to participate in an upcoming Indian Point Decommissioning Oversight Board meeting , currently scheduled for December 2022, and will continue to work with the Oversight Board and support public meetings related to issues of interest to the community. The Oversight Board requested the NRC staff's participation at the upcoming meeting , and the NRC staff is actively working with the Board to prepare for this public meeting . The NRC staff has also discussed decommissioning topics at public meetings held in the local vicinity and has worked hard to answer questions from State and local officials. We hope that your constituents find these public engagements with the NRC staff informative and helpful as the Indian Point decommissioning process continues .

The NRC strives to conduct an open and transparent rulemaking process. The NRC staff has engaged extensively with stakeholders on the proposed rule and provided an extended comment period on the proposed decommissioning rule for a total comment period of 180 days.

During the public comment period, the NRC staff held six public meetings , including four in-person meetings across the nation , to discuss the proposed rule . The NRC offered the opportunity for stakeholders to participate remotely in each public meeting . The NRC has received over 2,000 public comments on the proposed rule, including many from organizations and individuals affected by the decommissioning process. The NRC staff will consider and respond to the input as part of the development of the draft final rule for the Commission's consideration. Your letter is now included in the official docket for this rulemaking (Docket ID:

NRC-2015-0070) .
