Dear Senator Markey:

October 5, 2022 On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your August 30, 2022, letter urging consideration of issues related to the NRC's proposed rule on regulatory improvements for production and utilization facilities transitioning to decommissioning.

We appreciate and share your interest in ensuring that the NRC has a safe, effective, and efficient decommissioning process for nuclear power plants. During the 180-day public comment period on the proposed rule, over 2000 comments were submitted. In the proposed rule, the NRC staff requested input from the public on each of the topics addressed in your letter: NRC approval of the licensee's post-shutdown decommissioning activities report, the applicability of the Backfit Rule to decommissioning nuclear plants, and emergency planning requirements. The NRC staff will review, consider, and respond to this input as part of the development of the draft final rule for the Commission's consideration. Your letter is also included in the official record for this rulemaking (Docket ID: NRC-2015-0070).
