Friday, September 9, 2022 9:32:00 AM Good morning Shana, Per your request, please find below an explanation of the possession limits in the Westinghouse license. I have cced OGC and will add this email to ADAMS.

Historically, NRC has interpreted the license to mean that Westinghouse may possess the amount in 6.B AND the amount in 6.C. Therefore, while it could potentially be clarified in the future, paragraph 6.B does not prevent the licensee from possessing the amount listed in 6.C.

All of the materials specified in 6.A. through 6.H. of SNM-1107 are separated by and/or per the titles of the columns and thus are treated independently in the license (Westinghouse can have up to the quantity specified in column 8 of any/all of the materials specified in column 6). The NRC Form 374 (Materials license) is an OMB-approved form that has included the same type of materials description since at least the early 1980s.

Westinghouse did not request a change to the types of materials or possession limits in this license renewal request and intends to remove item G (depleted uranium flywheel) in the near future.

Should we find a need to clarify this section of the license, the removal of the flywheel may be an opportune time to clarify that item 6.B is intended to capture U-235 enriched to >5% (e.g. lab samples, check sources etc).

I have reviewed the Part 70 SNM licenses of a number of other similar licensees and have found the same column heading text in columns 6-8 of the other materials licenses.
