This email is being sent on behalf of Mohammad Shams, Director, Division of Advanced Reactors and Non-power Production and Utilization Facilities, Office of Nuclear Reactor Regulation, in response to your letter dated August 23, 2022 (agencywide document access management system accession number ML22235A117). The August 23, 2022, correspondence forwarded a draft presentation to the NRC for review as required by Section V, Paragraph 7.d, of Confirmatory Order (CO) EA-21-148. The National Institute for Standards and Technology (NIST) Center for Neutron Research (NCNR) had agreed to present at a publicly attended annual conference (such as the National Organization of Test, Research and Training Reactors (TRTR) annual meeting) and to submit a draft of the presentation to the NRC two months prior to the conference. The presentation is to address the cause of the February 3, 2021, event and corrective actions taken by NCNR and will include a discussion of the NRCs findings.

The NRC has reviewed the draft presentation and finds that it complies with Section V, Paragraph 7.d, of the CO. The NRC also has no comments on the content of the presentation. Therefore, it may be submitted to the TRTR and considered for inclusion at the 2022 TRTR Conference (or next TRTR conference) as-is. This completes our review as required by Paragraph 7.d.
