CORRECTION OF TYPOGRAPHICAL AND FORMAT ERRORS INADVERTENTLY INTRODUCED IN LICENSE AMENDMENT NO. 305 TO RENEWED FACILITY LICENSE NO. DPR-50 FOR THE THREE MILE ISLAND STATION, UNIT NO. 1

Dear David Rhoades:

On June 7, 2022 (Agencywide Documents Access and Management System (ADAMS)

Accession No. ML22074A131), the U.S. Nuclear Regulatory Commission (NRC) issued License Amendment No. 305 to Renewed Facility License No. DPR-50 for the Three Mile Island Nuclear Station, Unit No. 1 (TMI-1). The amendment was issued in response to the application dated April 29, 2021, (ML21145A183), as supplemented on May 26, 2022 (ML22146A349 (non-public)), pursuant to the provisions of Title 10 of the Code of Federal Regulations (10 CFR) 50.4, Written communications, 10 CFR 50.54(p), Conditions of licenses, 10 CFR 73.55(r), Alternative measures, and 10 CFR 50.90, Application for amendment of license, construction permit, or early site permit. The enclosures to the April 29, 2021, application are not publicly available in ADAMS as they contain security-related and safeguards information.

On July 27, 2022 (ML22208A093), Constellation Energy Generation, LLC (CEG) certified that all spent fuel assemblies have been permanently transferred from the TMI-1 spent fuel pool and place in storage with the independent spent fuel storage installation (ISFSI). This certification established the effective date for License Amendment Nos. 303 (ISFSI-Only Emergency Plan),

304 (ISFSI-Only Technical Specifications), and 305 (ISFSI-Only Security Plan). Each of these amendments specify that the amendment is effective on the date CEG notifies the NRC in writing that all spent fuel assemblies have been transferred out of the spent fuel pool and placed in dry storage within the ISFSI and shall be implemented within 90 days of the effective date.

Additionally, the implementation of the approved changes requires appropriate security measures to be in place during the transition from the current Plan to the ISFSI-only plan.

It can be demonstrated that the errors were introduced inadvertently in License Amendment No. 305 to Renewed Facility License No. DPR-50 due to a typographical error and use of incorrect format. Specifically, License Condition (2) Technical Specifications was incorrectly formatted. Also, it was incorrected stated, due to the typographically error, that August 25, 2022

D. Rhoades the Technical Specifications contained in Appendix A were revised through License Amendment No. 302, as opposed to Amendment No. 304. Amendment No. 304 was issued on April 19, 2022 (ML22081A232). Further, under License Condition (3), Physical Security, further typographically errors were made. Specifically, the superscript was incorrectly placed after the period and a comma was left out after May 6.

As a result, the errors were not requested by the licensee in its applications, and that the erroneous changes were not addressed in the notice to the public nor reviewed by the staff.

Under this circumstance, the changes that introduced the error were not proper to the amendment to the license because they were neither addressed in the notices nor reviewed, and correction of the errors are not a change to the staffs determination of no significant hazards or conclusions in its safety evaluation reports (non-public). The changes introduced by the errors were in fact improperly made.

Accordingly, consistent with guidance (ML103260096) and Staff Requirements Memorandum dated December 17, 1996 (ML003754054), the errors are corrected by this letter, instead of an amendment to the license.

A copy of the revised License Amendment No. 305 with the errors corrected for Renewed Facility License No. DPR-50 is found in the Enclosure. These revised changes to correct the typographical errors and format changes are effective immediately.
