MR. HOYLE:

The item, Mr: Chairman, is a Memorandum 9

of Understanding between the NRC and the Department of Energy 10 which is a superseding Memo of Understanding to the March 11 11 one of last year that was signed by Chairman Rowden and 12 Acting Administrator Frye.

13 Essentially, it updates changing ERDA to the 14 15 16 17 18 19 20 21 22 23 24 Ace-Federal Reponers, Inc.

25 Department of Energy in every instance and revising the section on ACRS access by the Department of Energy.

I do have all of your individual votes for this item, but in order to affirm it, we do need a vote first to have this item and vote on it on short notice.

CHAIRMAN HENDRIE:

Yes.

If you would, please, I would ask for your affir-mative vote then to hold a short-notice affirmation vote on this Memorandum of Understanding.

On page 4, we have deleted from the footnote at the suggestion of Commissioner Bradford a reference to the ECC bypass test facility.

CHAIRMAN HENDRIE:

Fine.

As an example of facilities.
