7 CHAIRMAN Hl!:NDRIE: Good. Name the numbers; I am 8 ready to vote.

9 MR. CHILK: SECY-78-J..62, which is an implementation 10 of an IAEA Safeguards Requirements, and it proposes to obtain 11 Commission approval of the public comment 1 a proposed I

]2 (not understandable) regulations, a proposed rule which would

- 13 14 15 enable the United States to be in compliance with respect to licensing activities in the IAEA.Agreement ent.ers in force.

The rules are being published at this time so that 16 the final regulations may be accomplished promptly once the 17 Senate gives its consent.

18 It_ involves a proposed. rule. The appropriate com-19 mittees are to be notified. A public notice will be issued.

20 The General Accounting Office approval of the II 21 reporting requirements will be obtained before we go final form.

22 23 All 3 of you have ap~roved it, Mr. Gilinsky noting 24 without objection ... Mr. Kennedy voted for it, although he is Ace-Federal Reporters, Inc.

3 MR. CHILK: The seco~d one, the last one, is SECY-4 78-173. It's a request to delegate too additional authority 5 for dealing with petitions for ~ulemaking. The delegation 6 will authorize EDO to deny any petition for rulemaking which 7 doesn't substantially modify exi,sting precedent and authorizes a him to propose exceptions from !!licensing requirements in 9 matters in which there .is backgr:Ound and existing precedent*.

10 Also, it involves the' notification of Congres.sional 11 Committees, a public announcement.

12 All of you have voted.'. for it, including Commissioner 13 Kennedy who is not present.

14 I ask you for an affirmative vote.
