Title:

Meeting between the U.S. NRC and Tennessee Valley Authority to Discuss Topics Associated with Pre-Application on Matters Related to the Development of a Construction Permit Application for the Clinch River Nuclear Site (Docket No. 99902056)

The purpose of this meeting was to discuss topics associated with Tennessee Valley Authority's (TVAs) preparation of a construction permit application for the Clinch River Nuclear Site that may require clarification and/or technical interactions. Specific topics discussed were associated with the following three subject areas related to the submittal of the Environmental Report (ER) for the Clinch River Nuclear (CRN) Site:

Update on Exemption Request for 10 CFR 2.101(a)(5)

Purpose and Need Discussion Coordination with Other Agencies and Tribes Another topic related to a coordinated submittal of common subject areas within the Preliminary Safety Analysis Report and the Environmental Report was identified for a potential future public discussion. NRC Project Managers were present to give feedback to TVA on the above topics.

Summary of Meeting TVA provided an update on an exemption request that will be submitted by letter within the next 30 days (around August 30, 2022). The request is within the current regulatory framework of 10 CFR 2.101(a)(5) and will allow TVA to submit the ER earlier in the process. TVA plans to rely primarily on the CRN Site ESP ER in developing the CRN Site CP ER.

TVA provided clarification on the purpose and need statement for the upcoming ER. The purpose and need statement will be consistent with that of the ER submitted for the ESP application. TVA plans on demonstrating conformance with the characterization of purpose and need in the CRN Site ESP Environmental Report that informs the NRCs CRN EIS and avoid any deviations if possible.

The plans for TVAs interactions with Federal and State agencies and Tribes was discussed.

TVA indicated that the interactions would begin once the plan has been finalized. NRC staff suggested that TVA begin interactions very early in the process, perhaps even before a plan is finalized, to keep all stakeholders informed of the CRN Site plans and allow time for agencies to initiate preparations for the CRN Site CP activities and to allow time for agencies and Tribes to plan for future stakeholder meetings. Early interactions would also inform the development of

plan rather than finalizing a plan and then engaging in interactions with local, state, Federal, and Tribal organizations.
