PART I.B -- INFORMATION NOT LOCATED OR WITHHELD FROM DISCLOSURE We did not locate any agency records responsive to your request. Note: Agencies may treat three discrete categories of law enforcement and national security records as not subject to the FOIA ("exclusions"). See 5 U.S.C. 552(c). On May 18, 2022, you agreed to perfect the remainder of Item 9 in your request. Item 9 was "all documents referenced in the Office of the Inspector General investigative report issued on March 6, 2014 entitled NRC Oversight of Decommissioning Activities at the Shallow Land Disposal Area Consistent with USACE MOU, from OIG Case No. 12-59, attached as Exhibit C in your request.
Item 9e was responded to in the 5th interim response, dated October 29, 2021.
Items 9c.ii, 9g, 9h, 9k, 9m, 9n, 9o, 9p, 9q, 9s, 9w, 9x, 9y, 9aa, and a portion of 9ee were responded to in the 7th interim response, dated June 10, 2022.
On June 29, 2022, we sent you fee estimates from NRC staff on the remaining documents in Item 9. The fee estimate was over $250, therefore an advanced payment was due back to us by July 14, 2022. We had a meeting regarding fees on July 15, 2022, where we asked for a response no later then August 8, 2022. We provided additional information about the fees on July 28, 2022.
As we have not received a response by August 8, 2022, we are administratively closing this case due to fees. You may file a new FOIA request for the remainder of the items from your initial FOIA request.
