Dear Mr. Chairman:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), as required by Section 102(c)(3) of the Nuclear Energy Innovation and Modernization Act (NEIMA), I am writing to notify you that, pending receipt of additional information from the licensee, the NRC did not issue a final safety evaluation for a license amendment request (LAR) within 180 days from the 2-year issuance date set in the NEIMA generic milestone schedule.
On January 14, 2020, the Tennessee Valley Authority (TVA) submitted to the NRC, for review and approval, a LAR for a new hydrologic analysis for Sequoyah Nuclear Plant, Units 1 and 2.
The NRC staff accepted the LAR for review on February 20, 2020. In mid-2021, while working to respond to NRC staff requests for additional information and regulatory audit questions, TVA identified a nonconservative dam water level assumption in its LAR flood analysis and a secondary impact of this assumption related to rock/soil erosion if dam spillways are overtopped. TVA plans to submit to the NRC a supplement to the LAR to address the nonconservative assumption by October 27, 2022. Thus, due to TVAs delay in submitting responses to the staffs requests, the NRC staff was not able to issue the final safety evaluation for this LAR within 180 days from the 2-year issuance date set in the generic milestone schedule. Upon receipt of TVAs LAR supplement, the NRC staff will take timely action to complete its review of the LAR.
