- 3. NRC Certificate of Compliance (CoC) No. 9390 Revision 0, NAC OPTIMUS-L Package, December 16, 2021 NAC International Inc. (NAC), hereby, notifies the NRC of fabrication activities associated with the NAC OPTIMUS-H and -L packagings that are to be used in the United States. All fabrication, inspection and testing activities have been and will continue to be conducted under the NAC Quality Assurance Program (QAP) which meets the requirements of 10 CFR 71, Subpart H.
Per 10 CFR 71.93(c), a CoC holder or applicant shall notify the NRC 45-days in advance of starting fabrication of the first packaging under a CoC. Contrary to this requirement, NAC has started fabrication of the first -H and -L packagings to be used in the United States without giving the NRC proper advanced notice. NAC has entered this issue into our Corrective Action Program (CAP) under Corrective Action Report (CAR) 22-03. The following provides a status of those packages that are currently in fabrication and those that have been completed.

Current Status: In fabrication Note, the OPTIMUS-H CoC initial issuance is currently under NRC review (References 1 and 2) and the OPTIMUS-L CoC was issued December 16, 2021 (Reference 3). Also, the first -H packaging fabrication began in October 2018 prior to NAC becoming a CoC applicant for either the -H or -L packaging. The first -L package fabrication began in September 2021.
Upon request from the NRC, NAC will make provisions for the NRC staff to inspect the premises and facilities where the OPTIMUS packages and/or their components are fabricated, tested or stored, and to permit to perform tests that the NRC deems necessary. In addition, NAC will provide the NRC with any fabrication records associated with the OPTIMUS packages should that be requested by the NRC.
