THREE MILE ISLAND, UNIT 2 - PARTIAL EXEMPTIONS FROM CERTAIN RECORD RETENTION REQUIREMENTS AND CONFORMING AMENDMENT (EPID: L-2021-LLE-0045)
Dear John Sauger:
The U.S. Nuclear Regulatory Commission (NRC) has granted the partial exemptions from the recordkeeping requirements of Sections 50.71(c), Maintenance of records, making of reports, and 50.59(d)(3), Changes, tests, and experiments, of Title 10 of the Code of Federal Regulations (10 CFR) and Criterion XVII of Appendix B, Quality Assurance Criteria for Nuclear Power Plants and Fuel Reprocessing Plants, to 10 CFR Part 50, as requested in TMI-2 Solutions, LLC (TMI-2 Solutions) letter dated October 5, 2021(Agencywide Documents Access and Management System (ADAMS) Accession No. ML21279A278), as supplemented, on December 15, 2021 (ML21354A027). The granted partial exemptions will eliminate the requirements to maintain certain records that are no longer necessary since the Three Mile Island Nuclear Station, Unit 2 (TMI-2), has permanently shut down and the certification of permanent fuel removal in accordance with 10 CFR 50.82(a)(1), Termination of license for power reactor licensees, was satisfied.
In the October 5, 2022, application, in Attachment 2, TMI-2 Solutions requests a conforming amendment, upon approval of the exemptions. Please find the exemptions in Enclosure 1, the approved conforming amendment in Enclosure 2, and the NRC staffs safety evaluation for the conforming amendment in Enclosure 3. A copy of the exemptions and conforming amendment will be sent to the Office of the Federal Register for publication.
In accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC Web site at https://www.nrc.gov/reading-rm/adams.html.
