SUBJECT: NRC INSPECTION REPORT 150-00042/2022-002 AND NOTICE OF VIOLATION

Dear Mr. Hulsey:

This letter refers to the unannounced reciprocity inspection conducted on May 4, 2022, at a

temporary jobsite at 165 Lost Cabin Road, Lysite, Wyoming. The purpose of the inspection was

to examine activities conducted under a General License pursuant to Title 10 Code of Federal

Regulations (CFR) Part 150.20 for your activities performed in Lysite, Wyoming, an area of

exclusive Federal jurisdiction, as they relate to public health and safety and to confirm

compliance with the U.S. Nuclear Regulatory Commissions (NRCs) rules and regulations and

with the conditions of your license. Within these areas, the inspection consisted of a selected

examination of procedures and representative records and interviews with personnel. The

preliminary inspection findings were discussed with Mr. Chris Baker during the onsite portion of

the inspection on May 4, 2022. A final exit meeting was held telephonically with you on June 29,

2022.

Based on the results of this inspection, the NRC has determined that a Severity Level IV

violation of NRC requirements occurred. The violation was evaluated in accordance with the

NRC Enforcement Policy which can be found on the NRCs Web site at

https://www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html. The violation involved a

failure to meet requirements in 10 CFR Part 37 and is characterized in the non-public enclosure

to this letter. The violation is being cited in the enclosed Notice of Violation (Notice) because it

was identified by the NRC during the inspection.

You are required to respond to this letter and should follow the instructions specified in the

enclosed Notice when preparing your response. The guidance in NRC Information Notice 96-28,

Suggested Guidance Relating to Development and Implementation of Corrective Action, may

be helpful in preparing your response. You can find the Information Notice on the NRC website

Information regarding the reason for the violation, the corrective actions taken and planned to

correct the violation and prevent recurrence, and the date when full compliance will be (was)

achieved should be addressed. The NRC review of your response to the Notice will also

determine whether further enforcement action is necessary to ensure compliance with

regulatory requirements.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice and Procedure, a copy of

this cover letter will be made available electronically for public inspection in the NRC Public

Document Room or from the NRCs ADAMS, accessible from the NRC website at

http://www.nrc.gov/reading-rm/adams.html.

However, the non-public enclosure to this letter (Notice) contains Security-Related Information

withheld under 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present

a security vulnerability. Therefore, the material in this enclosure will not be made available

electronically for public inspection. Additionally, if Security-Related Information is necessary to

provide an acceptable response to the enclosure, please mark your entire response Security-

Related Information in accordance with 10 CFR 2.390(d)(1) and follow the instructions for

withholding in 10 CFR 2.390(b)(1).
