Dear Ms. Nair:

The U.S. Nuclear Regulatory Commission (NRC) uses the Integrated Materials Performance Evaluation Program (IMPEP) for the evaluation of Agreement State programs. Per our previous interaction, I will be the team leader for the follow-up IMPEP review of the Maryland Agreement State Program scheduled for August 23-25, 2022. The follow-up IMPEP will be focused on the Technical Quality of Licensing Action performance indicator and the review team will include Farrah Gaskins, NRC Region I, and Tyler Kruse, State of Minnesota.

Enclosed is the Integrated Materials Performance Evaluation Program Questionnaire. The questionnaire was previously provided to you electronically on June 28, 2022. I ask that you send your responses, related to the Technical Quality of Licensing Actions performance indicator, via e-mail to stephen.poy@nrc.gov by July 25, 2022. I previously sent the questionnaire in advance of this IMPEP review scheduling letter in order to provide time for you to allocate the staff resources necessary to complete the document by the requested date. I encourage you to use electronic documents and provide them in advance of the review to the extent possible, to allow team members to better prepare for the on-site review.

In order to help the Agreement States and the U.S. Nuclear Regulatory Commission (NRC) remain knowledgeable of each others program, the NRC conducts one-day periodic meetings with Agreement States between IMPEP reviews. This letter confirms that, through previous coordination, the meeting has been scheduled for August and will be held in your offices. The meeting will be conducted in accordance with Office of Federal and State Materials and Environmental Management Programs Procedure SA-116, Periodic Meetings Between IMPEP Reviews. The likely topics for discussion at this meeting are listed in the enclosed agenda. Also included with the questionnaire is the document Materials Requested to Be Available for the On-Site Portion of an IMPEP Review. We encourage States to have the items listed prepared prior to the IMPEP teams arrival.

Recommendations:

The team recommended that Maryland review the qualifications of all RSOs, AUs, and AMPs listed on their medical licenses to ensure that they meet the qualifications in accordance with Marylands regulations for medical use of byproduct material.

The team recommended that Maryland develop and implement a procedure to ensure protection of sensitive information as it applies to written correspondence with licensees.
