REGARDING LICENSE AMENDMENT REQUEST TO ADOPT 10 CFR 50.69, RISK-INFORMED CATEGORIZATION AND TREATMENT OF STRUCTURES, SYSTEMS AND COMPONENTS FOR NUCLEAR POWER REACTORS (EPID L-2021-LLA-0207)

Dear Mr. Schuetz:

By letter dated November 9, 2021 (Agencywide Documents Access and Management System Accession No. ML21314A224), as supplemented by letter dated May 10, 2022 (ML22130A591),

Energy Northwest submitted a license amendment request for Columbia Generating Station.

The amendment would modify the Columbia licensing basis by the addition of a license condition to allow for the implementation of the provisions of Title 10 of the Code of Federal Regulations Section 50.69, Risk-informed categorization and treatment of structures, systems and components for nuclear power reactors.

To supports its review of the license amendment request, the U.S. Nuclear Regulatory Commission (NRC) staff conducted a virtual regulatory audit on March 30, 2022. During the regulatory audit, the NRC staff reviewed documents and held discussions with the members of Energy Northwest and its representatives. The regulatory audit summary report is enclosed with this letter.

SUMMARY

IN SUPPORT OF LICENSE AMENDMENT REQUEST TO ADOPT 10 CFR 50.69, RISK-INFORMED CATEGORIZATION AND TREATMENT OF STRUCTURES, SYSTEMS AND COMPONENTS FOR NUCLEAR POWER REACTORS ENERGY NORTHWEST COLUMBIA GENERATING STATION DOCKET NO. 50-397

1.0 BACKGROUND

By application dated November 9, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21314A224), as supplemented by letter dated May 10, 2022 (ML22130A591), Energy Northwest (the licensee) submitted a license amendment request (LAR) for Columbia Generating Station (Columbia). The proposed amendment would modify the Columbia licensing basis by the addition of a license condition to allow for the implementation of the provisions of Title 10 of the Code of Federal Regulations (10 CFR) Section 50.69, Risk-informed categorization and treatment of structures, systems and components for nuclear power reactors.

On February 9, 2022 (ML22032A014), the U.S. Nuclear Regulatory Commission (NRC) issued an audit plan, which provided the list of requested documents and other details pertaining to the audit. An audit team, consisting of NRC staff and one contractor from the Pacific Northwest National Laboratory (PNNL), conducted a remote regulatory audit to support the review of the LAR on March 30, 2022. The purpose of the audit was to gain an understanding of the information needed to support the NRC staffs licensing decision regarding the LAR and to develop requests for additional information. The information submitted in support of the LAR is under final review in accordance with Office of Nuclear Reactor Regulation Office Instruction LIC-101, Revision 6, License Amendment Review Procedures (ML19248C539).

The regulatory audit is a planned license or regulation-related activity that includes the examination and evaluation of primarily non-docketed information. The regulatory audit is conducted with the intent to gain understanding, to verify information, and/or to identify information that will require docketing to support the basis of a licensing or regulatory decision.

Performing a regulatory audit of the licensees information is expected to assist the NRC staff in efficiently conducting its review or gain insights on the licensees processes or procedures.

Information that the NRC staff relies upon to make the safety determination must be submitted on the docket. However, the NRC staff may review supporting information retained as records under 10 CFR 50.71, Maintenance of records, making of reports, and/or 10 CFR 54.37, Additional records and recordkeeping requirements, which, although not required to be submitted as part of the licensing action, would help the NRC staff better understand the licensees submitted information.

2.0 AUDIT ACTIVITIES AND OBSERVATIONS The NRC staff conducted a desk audit consistent with the transmittal of the audit plan (ML22032A014) to Energy Northwest. The purpose of the audit was to (1) gain a better understanding of the LAR to enable staffs review for technical and regulatory acceptability, and (2) identify additional information required from the licensee on the docket to support the NRC staff licensing or regulatory decision.

The licensee provided the documents requested by the NRC staff in the audit plan to an electronic reading room. The NRC staff reviewed these documents during the desk audit to inform the discussions held during the virtual audit.

The virtual audit was conducted on March 30, 2022. The audit team held detailed discussions with the licensee on various topics, supported by the licensees presentations and prepared responses to audit questions. The NRC staff used the information gathered from the audit to determine whether additional information is warranted on the docket to support rendering of an NRC staff finding. The attachment to this audit report provides a list of the information the NRC staff reviewed throughout the audit.

3.0 RESULTS OF THE AUDIT The NRC staff did not make any regulatory decisions regarding the LAR at the time of the audit.

Upon conclusion of the audit the licensee opted to provide a supplement that addressed the audit questions in the audit plan in order to docket the additional information identified. The NRC staff indicated that it would determine whether a request for additional information was needed upon review of the supplement. In a supplement dated May 10, 2022 (ML22130A591), the licensee provided response to the audit questions. The NRC staff has reviewed the response and determined that no additional information is needed at this time.
